Customer surveys: protecting personal data

Data protection in customer surveys

Data protection should always be a top priority in a customer survey. This applies to both offline and online customer surveys. If you allow customer data (responses, email addresses, names or attributes) to be lost, reused or even sold, you will not only lose customers; you may also be committing a criminal offence. You should therefore ask your data protection officer and IT department to assess any customer survey tool you are considering.

Tip: Do not allow your data to leave the jurisdiction of the Federal Republic of Germany. Use a provider based in Germany or at least in the EU. Make sure it complies with the GDPR.

Important: Please bear the following in mind:

  • If you use a provider based abroad, your data will be collected and processed on your behalf by an online provider based outside Germany.

  • This results in a data transfer to a third country. An agreement based on the EU Standard Contractual Clauses should be concluded between the controller (you) and the processor (the online provider based abroad).

  • According to the European Commission, can an adequate level of data protection be assumed in the country concerned (making such an EU standard agreement possible)?

  • Without an agreement, the data transfer is unlawful, potentially making you criminally liable and leaving your customers’ data unprotected.

  • If you use a provider based in Germany, you can conclude a data processing agreement pursuant to Article 28 GDPR.

LamaPoll is designed for privacy-conscious and security-conscious organisations in Germany, Austria and Switzerland. We take GDPR-compliant data handling very seriously and are therefore one of the leading providers of secure online surveys.
