Data protection and the US CLOUD Act
LamaPoll is operated in Germany. Data is processed on German infrastructure and LamaPoll does not rely on a US cloud provider. Our information security is certified to ISO 27001, ISO 27017 and ISO 27018, and audited to TISAX® AL2.
When choosing a survey tool, it is not only where data is physically stored that matters, but also the law that applies to the provider. SurveyMonkey is a US company and is therefore subject to US law. Under certain conditions, the US CLOUD Act can allow US authorities to require access to data controlled by a US provider, even if that data is stored outside the United States.
Mechanisms such as the EU-US Data Privacy Framework and Standard Contractual Clauses provide legal frameworks for international data transfers. They do not change the fact that a US provider remains subject to US law. Read more in our article Data Privacy Framework: Data transfers to the USA.
If required, LamaPoll enters into a data processing agreement with you. Data processing remains in Germany and does not involve a US cloud provider.
